I am presently under scrutiny for another 2 years than the earlier report. In all, my understanding so far is that first of all, it is important not to come under IT department scrutiny. For this it is better that one is not involved in any high cash purchases as long as one remains an NRI and for a further 2 years after return. Even then it is better to go for loan purchases. For those in scrutiny, it is better to spend the cash so earned abroad and send remittances as required for family maintenance and pay tax thereon and not bother about NRI time completion.  Because the problems involved is huge as the department is awaiting a supreme court verdict on this issue. This could take next 10-15 years. So for this time period all seafarers - BE ALERT. And lead a quiet life.

There is a huge difference between salary and allowance allowance. Your employer must be treating part of $3,500 as salary and part as allowance for foreign travel. Ask your employer.
If they are treating all of $3,500 as salary, the total amount is your taxable income. Evidently, employer will not do this.

1. I meant the financial year April 2010 to March 2011, that we are almost halfway through

Only forex upload of around $3500 per month and I need to take care all local expenses at "Oman" or "Kuwait" (place not finalised yet). $3500 per month is all what I will be eligible for irrespective of what you call as allowance or salary
3. "Oman" or "Kuwait" (place not finalised yet), Business visa, No tax there in the alien country
4. India employer will upload this amount in my international travel card, which i can withdraw and utilise there.

2. Please provide more details. Evidently, with your salary equivalent in USD you will not work in a foreign company where you have to pay for rent, travel and food from your own pocket. Will you be getting any travel allowance?
3. Which country are you going to? On which visa? As you may have to pay income tax in the foreign country.
4. Who will be paying you while you are in a foreign country? Your India company or its associated company in the foreign country?

During this year april 10 to march 11, I am likely to be away form India on official work. During this period I will be getting my salary equivalent money in USD through my travel card and no Indian salary during this period. I need to take care of my expenses like, rent, food, etc at onsite place. Satisfying 182 days stay in India I will not come to know till the end of this project.

I would like to be clarified on, assume both the cases 182 days more and less,

a) India Tax incidence on the monthly sum uploaded in my travel card (USD)
b) Whether my employer is entitled to deduct TDS on the upload
c) Is there any limit on monthly forex upload with respect to abroad travel

Appreciate if any one can revert back on this queries as I need to give my acceptance or otherwise for taking up this project.
